Summary/Abstract: The submitted article analyzes whether disciplinary proceedings in the affairs of civil (state) servants fall under Art. 6 of the European Convention on Human Rights, which would guarantee a right to a fair trial at the international (European) level. In matters of the relation of disciplinary proceedings to Art. 6 of the ECHR, the author analyzes the case-law of the European Court of Human Rights, as well as the case-law of the Czech courts. In relation to analyzed topic, the author deals with the concept of „civil rights and obligations“ and „any criminal charge“. The author also addresses the suitability of the model of disciplinary proceedings in the affairs of civil (state) servants.
