The descent from the father in judicial partition proceedings

Summary/Abstract: The judicial partition proceedings are specific claim proceedings, regulated in Part Three, Chapter Twenty-Nine of the Civil Procedure Code of the Republic of Bulgaria. Those proceedings examine preliminary judicial issues, one of which is challenging the descent. In respect to the resolving of that issue, an heir may be included, or, respectively, excluded from the co-partitioners with the enactment of the court decision to admit the partition. Subject of study is the extent to which the descent from the father can be established and challenged in partition proceedings.
