Summary/Abstract: In the report the author examines the characteristics of the legal effect of the recording of a mortgage deed in several legal systems. The accent is put on the question whether the recording of the deed is a prerequisite for the validity of the mortgage deed or the latter only makes the mortgage effective against the third parties who have conflicting rights on the same real property.
