Comparative Analysis оf the Law Provisions аbout the Limited Liability Company froм the Creditor Protection Perspective

Summary/Abstract: The article provides a brief overview over the changes in the legal framework for the protection of creditors of the limited liability companies in Bulgaria and Germany. Because of its affordability and flexibility, this company plays a very important role in trade, but its regulation leaves some major gaps in the protection of creditors. These problems are not only typical for our country, so it is of importance to review the legal framework in other countries, as well as the possible good practices in them, which can be applied in Bulgaria. In this paper, through the systematization of the main approaches to the protection of creditors, was made an analysis of the special company law of the limited liability company, changes in the regulation in the light of the protection of creditors and a comparison with the legal provisions in the German doctrine.
