Identicality of the factual and legal background as a prerequisite for changing administrative decision, based on which party gained right, under Article 155 kpa

Summary/Abstract: Under Article 155 of the polish administrative proceeding code, the final decision may be changed in any time, if the specific law provisions does not preclude such a change and the public interest or justified personal interes supports the change. In the article author critizes the view, formulated on grounds of given provision, that ideniticality of the factual and legal backgrounds is a prerequisite for changing administrative decision. He claims that in fact the eseence of proceding carried under art. 155 kpa is taking into account, while issuing amended decision, change of factual background that occurred after the original decision had been issued.
