Understanding human dignity and its role in the process of lawmaking and applying the law. A proposal for a compliance test of legal regulations with the principle of human dignity

Summary/Abstract: In the Preamble of Constitution of the Republic of Poland the inherent dignity of the person is a value that limits application of all norms, including the constitutional ones. Human dignity referred to therein is dignity of a human being — the core of humanity present in any person, inherent, inalienable and inviolable. The article presents the interpretation of the notion of “human dignity” in the jurisprudence of the Constitutional Tribunal and the Supreme Court. In the conclusion, the author proposes a compliance test for the existent and draft legal regulations with the constitutional principle of human dignity.
