The Shaping of Article 4 of the Act on Legal Advisers in the Years 1992–1997 in Light of the Reso-lutions of the National Symposia of Legal Advisers and the National Council of Legal Advisers

Summary/Abstract: The article is of historical nature, connected with the thirty-fifth anniversary of the founding of the professional self-government of legal advisers, and concerns the years 1990–1994. This period was marked by intense efforts by the bodies of the self-government to carve out a new model for providing legal aid by legal advisers, and, in particular, to formulate the content of the key provision of the Act on Legal Advisers, i.e. Article 4, which governs the subjective and objective scope of the legal assistance rendered. Legal literature contains different accounts of its history. The article points out the author of the provision, the circumstances and the date of drafting the so-called negative definition of Article 4, and the significance of this definition. The author accomplishes this predominantly on the basis of the resolutions of the highest bodies of the professional self-government of the period, and her own reflections as a participant in the events.
