Summary/Abstract: The paper discusses if there are differences in the protection level between the right to a fair trial guaranteed by the European Convention on Human Rights and the Charter of Fundamental Rights of the European Union. Several rights are recognized by the Court of Justice of the European Union and the European Court of Human Rights of the right to a fair trial such as: the right to a fair hearing, right to a public trial and public pronouncement of judgement, right to adjudication by an impartial and independent tribunal, right to a trial within a reasonable time and right to enforcement. Relevant decisions of the Court of Justice of the European Union will be presented and the development of the right to a fair trial in Bosnia and Herzegovina contrasted.
