Practical matters regarding the settlement of conflicts between the right to brand name, the right to trade name and the right to domain name

Summary/Abstract: The article analysis the main difficulties in solving conflicts between signes registered as domain names, as trade names and as trade marks, by different right holders. It is argued that difficulties are due to the registration process of domain names and to the lack of civil procedural remedies clearly regulated by the national trade mark law. Proposals are made for improvement of civil procedure remedies în the national legislation.
