Summary/Abstract: After the Union of the Romanian Principalities in 1859, a vast and, at the same time, difficult work of legislation and legislative unification started in the united Romania for the purpose of organizing the new modern and unitary state. Thus, while under the reign of Alexandru Ioan Cuza, the first piece of legislation regarding the intellectual property right was adopted – the Law of Press of 13 April 1862 which, throughout 11 articles, also comprised provisions regarding copyright, under the reign of Carol I, the first law on trademarks in this part of Europe was adopted, namely the Law of 14 April 1879 on manufacturer’s brands and trademarks. The adoption of the Law on manufacturer's brands and trademarks had a determining role in the modern development of market economy and international trade, providing consumers with the possibility to choose the products from the same category and the manufacturers and traders with the protection of their brand. This article presents a short retrospective of legal regulations regarding trademarks during the 130 years since the first adoption of a law in this field, as well as a number of lege ferenda proposals related to the provisions of the law in force.
