State and Legal Order, Legal State and State Law

Summary/Abstract: Professor Vračar reached his conclusions about the legal state and the state law from his own theory on state and law. According to this theory, the state is a tool and the law is the model of political constituency of the global society. Therefore, in reality, state and law are related in such a way that they represent the highest level of unity, while retaining the specificity of separate phenomena, meaning that they represent two phenomena, not one. Professor Vračar expresses this unity by the term ,,state and legal order‘‘. In his doctoral discussion ,,Social content of the state and legal order‘‘, which he presented in 1960, professor Vračar presented the basic institutions of the legal state through the term ,,legalization of the state‘‘.
