Summary/Abstract: The Constitution of Bosnia and Herzegovina does not contain explicit state property provisions; rather, some provisions serve as an indirect source of law on BiH property. The property is divided into three types: private, public and administrative. However, the Constitution of Bosnia and Herzegovina contains sufficient number of provisions to create a legal basis for the adoption of a property law in the form of amendments. This can be achieved by joint economic projects, while the use of energy sources will cease to be an additional competence of BiH institutions and become the competence of BiH institutions under the same article of the Constitution of Bosnia and Herzegovina. This will create conditions for BiH institutions to implement the legal obligation of the Constitutional Court of BiH to adopt the law on state property, and for BiH to become the owner of various legal facilities, in accordance with the Constitution of Bosnia and Herzegovina.
