Summary/Abstract: This article deals with problematic aspects of the definition of relevant market and the assessment of a dominant position in the heating sector of the Czech Republic. The author analyses also a possibility to apply the essential facilities doctrine with regard to a third party access in district heating networks. In comparison to other European countries, there is a high utilization of district heating systems in the Czech Republic. A district heating system is usually considered to be a natural monopoly and competition law problems in the industry have been often considered before the Czech Office for the Protection of Competition. The author refers in the article also to the decisional practice of the European Commission as well as to decisions of German and Slovak national competition authorities.
