Legal Aspects of Habitat Fragmentation Caused by Construction of Roads

Summary/Abstract: Considering current reports of dramatic biodiversity loss worldwide, this article provides a brief examination of legal aspects related to an issue that belongs to the most significant causes of this adverse trend – habitat fragmentation. For practical reasons, it only deals with fragmentation caused by construction of roads. Since Czech legislation does not contain any provision dealing specifically with this issue, a combination of provisions that are more generally formulated must be used. Therefore, the article focuses especially on identification of the key legal instruments which are applicable in this context, and on a brief presentation of specific procedures designed in methodological documents dealing specifically with the issue of habitat fragmentation in the Czech Republic. The problems in question are also shortly confronted with current trends in Czech construction law.
