Insurance measures in criminal proceedings (I)

Summary/Abstract: In the existing context, where legislation on precautionary measures is frequently impacted by decisions passed by the Constitutional Court of Romania and the Hight Court of Cassation and Justice, this paper sets out to review certain practical issues and shortcomings related to the general conditions for taking precautionary measures. Without claiming to achieve an exhaustive analysis of the regulation on the general conditions for taking precautionary measures, due to the wide-ranging consequences of the legislation, this paper aims to capture the main issues that arise at the confluence of criminal procedure law with civil and civil procedure law in the process of establishing measures that affect the fundamental right to property.
