Summary/Abstract: The European area of freedom, security and justice represents a fundamental element of the European Union in response to the long-term global challenges, contributing to the consolidation and development of the 21st century European social market economy. This area we refer to guarantees to all citizens of the European Union, including third-country nationals, respect for fundamental rights enshrined in the Charter of Fundamental Rights of the European Union. In the policy areas of the European Union, such as the field of criminal law, where gaps have been identified in the implementation of Treaty obligations, it was imperative to take action on the basis of assessments of the practice in such field, in observance of the fundamental principles, such as subsidiarity and proportionality. These measures have led to a common understanding of the guiding principles underlying the European Union criminal law legislation, such as the interpretation of the basic legal concepts used in the EU criminal law and the manner in which criminal penalties can provide increased added value at this level.
