Summary/Abstract: The criminal offense of extortion is an old, archaic, conventional, classical crime that has been known in ancient history since ancient times, as well as in many laws throughout the region, Europe and the world. As such,it can not be said that in addition to all of its elements that make it, it is only a classical work, bearing in mind that in time, forms of organized crime have taken on. Apparently, it would be said that this is a conventional criminal offense, in which the circle is all over and counting, while on the other hand, the act of execution of this work has also got a different dimension, which also includes this work in violent crime. Many modern legislation criminalize extortion, although they are considered to be a criminal offense against property, as is the case with the Criminal Code of the Republic of Serbia, they also consider part of the elements of violence, and most probably it can be said that it is a violent property work. This is also supported by certain Laws which as the qualifying circumstances of this work precisely determine the violent manifestation of the act of execution of the work. The author in this paper first points to the general characteristics of violent crime, and then to the violent characteristics of this work, both in the criminal legislation of the Republic of Serbia and in the legislations of the region, on the basis of which it concludes the future incriminations of certain violent characteristics as qualifying circumstances of the part of extortion into legislative frameworks Republic of Serbia, which have already been implemented in comparative law.
