Summary/Abstract: Extremely high and flattering reviews of Bogišić and his work had for us only initial, problematic and hypothetical character. We found that he was only consequential representative of historical school of law because he systematically explored using a questionnaire living customary law and emptied it into the code. He thereby took account of modern developments in the European civil codification. His influence on Erlich is beyond doubt, whom many authors consider the founder of the sociology of law.
