THE CRIME OF VIOLENT BEHAVIOUR

Summary/Abstract: Violence is one of the most widely spread phenomena related to human society and human nature in general. It is defined as a form of demonstrating aggressive behaviour during which certain efforts are made to cause injury or pain. Different types of violence represent different forms of demonstrating social conflicts and contrasts, as well as negative effects of disturbed social relationships. That is a phenomenon which dominates in society becacuse it represents the form of demonstrating social relationships including individual, group, society. Violence follows a man through the whole civilization development. With the development of the man and technological development, the methods and means of committing violence changed too. In order to talk about the essence of violence, despite essential characteristics which every act of violence must have, i.e. it is necessary for it to be an act legally defined, illegal and committed crimes of violence have a special feature. In criminal law, the term ''violence'' is not a frequently used term, nor does it represent a general category. We are talking about a specific act, i.e. the use of force or a threat that the force will be used. Therefore, violence is illegal. One has to be cautious when it comes to using the term ''violence'', ''force'' and ''compulsion''. In spite of extreme similarity and partial congruence, there are several differences among these terms. In the Criminal Law of the Republic of Serbia, violence is a constitutional element of a large nimber of crimes such as acts against life and body, man's and citizen's freedom and rights, freedom of sexes, state bodies, property, humanity and other welfares protected by international law. But, violence has a special significance with crimes which are within the group of crimes against public order and peace, i.e. crime of violent behaviour specified in article 344. Public order is disturbed by those violent behaviours which cause citizens' uneasiness, as well as by those which are not directly pointed towards specific individuals but have a more general character. The incrimination of this crime includes extremely severe anti-social behaviour of individuals, which acquire the character of socially dangerous by disturbing citizens' peace or public order.
