CONTROLS OF SETTLEMENTS UNDERTAKEN ON EXPIRATION OF THE MANDATE OF LOCAL GOVERNMENT

Summary/Abstract: In present legal status, the settlements undertaken on the mandate expiration of the councillor, headman (mayor, president of the city) are the resolutions of the bodies which are local authorities entities and replacement regulations of the governors. The article concerns the issues of these acts control. This problem is particularly important both from the individuals' viewpoints who this act concerns as well as general interest expressed in need of the assurance, the seats filled in direct election, were bestowed by the person against whom there were no conditions for revocation of the mandate. The basic element of these acts control is the supervision executed by Administration Courts. Apart from that the resolutions stated a mandate expiration were submitted to administration control executed by governors within supervising competences they were entitled to. In both events the only control criterion is the legality of the decisions controlled.
