Summary/Abstract: Spatial organization of society, economy and state is an effect of a mutual relationship among all the members of a territory. This relationship is created during the process of decision taking. The decision mechanism should contribute to local and regional development. However, it cannot be achieved without the instruments of regional development that limit the powers of local authorities, at the same time showing the necessity of compromising and satisfying the individual expectations and the public good. One of the important instruments of this type is the system of public tenders. Modern management in the oublic sector obliges cities, parishes and regions to satisfy the community needs in the most effective way and makes it necessary to use the public tender law in contracts concerning services, deliveries or building works. Taking or not taking an action in this respect can seriously influence the spatial organization of a territory or indirectly other institutions and bodies shaping this territory. It is a guarantee of effective spending of public funds. The proper and professional preparation of the tender procedure can be very labour-intensive as it demands a detailed documentation, keeping the deadlines and constructing the right contracts. Nevertheless, it gives a chance of realization of contracts shaping local development. At the same time, it cannot be forgotten that the same actions can cause spatial conflicts and become a barrier limiting the development.
