Summary/Abstract: The Insurance Distribution Act introduces an obligation to make an analysis of the client’s needs and requirements before the conclusion of the insurance contract based on the information provided by him. The lack of formalization of this process, and at the same time placing the distributor in the hands of sanctions means that one should consider how to meet the expectations of the legislator, while fulfilling the basic objectives of the regulation, which is the implementation of the IDD directive. The article discusses the aspect of misselling as the main reason for regulation. Then the essence of the needs analysis is presented. Important in this aspect are also discussions during legislative work, affecting the final shape of the Polish act on distribution. The article also discusses the aspect of subjects and subject matter of the analysis, the forms of its analysis and the practical barriers that distributors mayencounter, ultimately leading to the conclusion about the nature of the established and pro-quality regulation.
