Summary/Abstract: Punitive damages constitute a theoretically controversial but judicially enforced legal doctrine. The debate about punitive damages focuses on various legal problems that academics have been trying to solve over the last few decades. One of these issues concerns insurance coverage for punitive damages. There is no clear consensus today whether the law should allow insurance coverage of punitive damages. US courts conflict sharply: some deny coverage on grounds of public policy, but the majority allow coverage. This paper explains why insurability of punitive damages is such a controversial issue and how it is dealt with both by US judiciary and insurance practice.
