Summary/Abstract: The article present the main legal issues related to land ownership in the archaic period in Ancient Rome. The institutions of mancipatio and sacramentum prove the existence of collective ownership on the land. The meaning of the terms “familia” and “pecunia” is related to the property of the large patriarchal family and the family property regime as a transmission between collective and private property, confirmed by Lex Duodecim Tabularum.
