On compulsory latent defects insurance in property developer business

Summary/Abstract: The purpose of this article is try to elaborate a theoretical model of insurance that guarantees the purchasers of premises (especially dwellings) protection in the event of latent defects.In the first part of the paper, the authors present arguments which can justify the introduction of systemic solutions within the indicated scope, as well as analyse the chosen legal orders of other EU Member States. Subsequently, general assumptions of the proposed insurance are discussed, with some of them covered in variant approaches. The article concludes by the authors’ conclusions.
