Summary/Abstract: The paper concerns Directive 2016/97/EU on insurance distribution adopted by The European Council and Parliament on 20 January 2016 with the obligation to implement it until 23 February 2018 with respect to the provisions thereof regulating the method of creating and governance of insurance products. Considerations carried out in the text encompass the notion of the insurance product and governance thereof in the light of the new provisions on insurance distribution. Particular interest has been raised with respect to the manner of implementing the new provisions into the Polish legal system and their coherence with the insurance culture in Poland and in particular with respect to the traditional roles of the insurance intermediaries. Having this in mind, the Polish legislator should focus on such aspects of the insurance product governance that allow the addresses of new provisions to comply with the new obligations. It concerns mostly the insurance brokers and agents. As it seems, it is difficult to predict the real and not only formal scope of applying the provisions on product governance by different types of insurance distributors. It seems that uniform regulation of this issue does not guarantee the uniform performance thereof. Such a conclusion results from the different functions of the insurance distributors in Poland.
