Summary/Abstract: Freedom is reaffirmed as one of the internationally recognized indicators of the level of democracy and rule of law. This function gives it the actual characteristic of one of the major rulemaking factors, which obliges the legislator in modern societies not only to define precisely its objectively necessary measure but also to effectively protect it by the means inherent to the legitimate law.
