Summary/Abstract: Divorce is the only means by which a validly concluded marriage can be ended. The current law has widened the means by which married people can end their marriage; thus, along with the traditional judicial divorce, the spouses can end their marriage by notary procedure or by administrative procedure, before an officer of the city hall. The present study will describe the specifics of judiciary divorce in regard to material and territorial divorce, as well as the procedural quality of the parties by considering the regulation of divorce as a special procedure in by the Civil Procedure Code; we will also consider the material law provisions stated by the Civil Code.
