Summary/Abstract: The paper analyses the due conditions under which falls the dismissal for physical and psychical unsuitability of the employee, overlooking the judiciary practice outcomes which studied punctually reveal a range of mistakes of interpretation and application of legal texts. The results of the investigation show the necessity of a revival of the jurisprudence in the exposed topic.
