Summary/Abstract: The current paper aims to present succinctly an institution old by tradition and new by the legislative means which bring it to forefront: The New Civil Code and the New Code of Civil Procedure. Guardianship courts have come to be a frequent participant both in the mundane life of the citizens, but also in circumstances that affect the development of the individual in particular, out of the ordinary situations. In addition, a recent case, still pending in front of the court, will be exposed, due to its character of novelty and near controversy.
