Summary/Abstract: Evolution of the sovereignty concept in modern nation-states in the globalizing post-sovereign world is one of the key issues that receives the attention of experts. This paper analyzes the relation between the concept of sovereignty and the modern state, including the consequent creation of the “Westphalian“ international order and the inherent international law, which has been known for three and a half centuries, as those modern states grew and became more complex. By observing social tendencies and the diffusion of power in the post-modern international community, the author has adopted a view of the circular course of the sovereignty theory which broke off with its universalist and personal roots from the ancient world and the Middle Ages, made a long journey through history and finally found itself facing the issues of universal and comprehensive supra-state sovereignty. Adopting a value-judgement based attitude towards this process does not involve denial of sovereignty as such, but giving preference to one kind of sovereignty over another. Social reality and proponents of post-sovereign international order do not actually deny the concept of sovereignty in its essence, but merely deny capacities of certain nation-states to efficiently exercise it in the new circumstances.
