Summary/Abstract: The article deals with the problem of understanding of the notion of “serious breach of basic obligations” which is a premise of termination of labour contract without notice both for employer and employee. Because the the regulation is based on the same notion, in jurisprudence it is understood unanimously in most cases. The article contradicts this point of view and arguments, that the same notion “serious breach of basic obligations” should be interpreted in different ways for employer and employee. The reason is first of all the different meaning of guilt in breach of contract for employer and employee. While employee’s breach of contract must be faulted, in case of employer his guilt is not necessary. It means, that the employee is entitled to terminate the employment contract also in cases of non-culpable breach of contract by employer.
