Summary/Abstract: In the regulation of the New Civil Procedure Code, the appeal system has been rethought and transformed fundamentally, the extraordinary appeal itself knowing a series of metamorphoses, that determined us to lean on the present study.The appeal for anullment is an extraordinary form of appeal, of withdrawal, common and, in principle, not suspensive of execution, being regulated by art. 503 and following Civil Procedure Code. We must specify that it was originally created as a extraordinary form of appeal in art. 317-321 Civil Procedure Code, under the amendments made to the Civil Procedure Code from 1948, although its origins are much older, in jurisprudence being known as “action for anulment”, grounded on the former art. 735 Civ.Proc.Code(that concerned the nullity of procedural acts, among these being included the court decision ).
