Summary/Abstract: At this moment, of rethinking the factors influencing the functioning of market economy, studying the legal will limits of the contract of sale is a leading necessity.Socio-economic realities of the late XXth century and the first decade of XXI century have revealed an unprecedented increase of globalization, with the natural consequence of shaping the legal will of the contracts of sale.The contract of sale is a negotiated contract, as there is no interference in the legal will of the parties.Everyone is free to sell or buy. The principle of autonomy of will is the expression of individual freedom to enter into a contract or not, according to his interests. Moreover, the principle of autonomy of will not only be met at the contract of sale, but also to any other contract. But this freedom is not absolute, being limited by the rules of public order and morality.
