The Adaptation of the French Constitutional System to the European Integration

Summary/Abstract: The paper analyses the position of France towards the european integration. It is focused on the European Union and former European Communities law. The article is divided into three parts. In the first one, some historical aspects are stressed to explain the reasons of a rather conservative approach that France has had from the beginning of the integration and that is still very typical for this member state of the Union. The second part brings an analysis of the French constitutional texts related to the european integration. It presents the position of the French constitutional power and the rich evolution of the constitutional text caused by the activity of the French constitutional justice. The third and the most essential part of the paper is dedicated to the position held by the French judicial institutions towards the european law as it was the judicial power who has achieved the adaptation of the French constitutional system on the european integration. There is a rich jurisprudence concerning the primary as well as the secondary european law. Therefore, the paper deals with some essential points concerning the relation of France and the European Union that have been fixed by the French judge.
