Summary/Abstract: Revaluating the results and legal practices sedimentation, the New Civil Code has brought a number of changes in guarantees matter, embodied in institutional and terminological resetting or in genuine legislative innovations.Amendments made by the New Civil Code, practically require a current analysis of the legislative and legal situation by reference to the old civil code provisions, for deceleration of those force lines representing legal permanence, but also of the main aspects of novelty.As a matter of legislative innovation induced by the New Civil Code in matters of real guarantees, a terminology change is remarked, real guarantee is established on movable assets now being referred to as "movable mortgage", while the term "pledge" is used by the New Civil Code to define only those movable guarantees with dispossession.
