Proceeding measure of the provisional release in light of the provisions of the new Criminal Procedure Code

Summary/Abstract: Through the provisions of the Criminal Procedure Code, is provided that provisional release measure aims to ensure the normal operation of the criminal process, presenting it in two ways: provisional release under judicial control and bail, both ways changed by the provisions of Law no. 281/2003, Law no. 356/2006, although to a small extent and by the provisions of Law no. 202/2010, currently being distinctly regulated by the provisions of art. 202 of Law no. 135/2010, on the Criminal Procedure Code as preventive measures with restraint, house arrest and detention.
