Res judicata in the regulation of the New Civil Procedure Code

Summary/Abstract: The judgment, namely the jurisdictional act, produces two categories of effects: substantial effects and procedural effects. Among the procedural effects of the court decision is also the fact that it enjoys the authority (power) of res judicata, together with the effect of the court dismisall, the effect of the executional power of the decision (limited, however, to the judgments likely to be enforced under the law), the effect of the authentic character, the binding effect for the parties and the erga omnes effect of the court judgement.
