Summary/Abstract: During the performance of the individual employment agreements and the collective agreements a lot of incidents might affect the execution of the agreements according to the initial wish of the parties. One of these incidents also implies the transfer of undertakings. The legislator, according to the provisions of the EU Law provided as a rule the safeguarding of employment agreements in order to protect the employees’ rights. Taking into account the complexity of legal operations in the event of transfer of undertakings, the case of employment agreements deserves special attention. This study aims to analyze the legal status of the employment agreements in the event of transfer of undertakings, mainly regarding the legal safeguarding of employees from the transferred undertaking.
