Summary/Abstract: In addition to the obligation of the seller to ensure the buyer against defects of the sold product, the New Romanian Civil Code regulates the obligation on the seller to be liable for the proper functioning of the sold products in the event of malfunctions within the guarantee period. This paper examines the specific elements of this new institution and highlights the differences between the guarantee for the defects of the sold products and the guarantee for the proper functioning.
