Summary/Abstract: One of the circumstances that prevent the completion of arbitration is the tactic used by the defendant to refuse payment of the advance on arbitration costs, in which case this obligation rests with the claimant, and if he does not pay the defendant’s share the arbitration comes to a standstill. This article analyzes theoretically grounded solutions to overcome this situation and how these are reflected in the case law.
