Summary/Abstract: Cloud computing contract is a form of an outsourcing contract. The concept of cloud computing is used to indicate virtual platforms or infrastructures, that allow, among other things, storage and processing of data, performance of applications and service delivery in various forms, via a network, the Internet [1]. The cloud provider imposes an adhesion contract to the cloud customer, in which, among other things, inserts a clause on choice of forum for settling disputes between provider and customer. The effectiveness of this clause is treated differently depending on the quality of cloud customer: consumer or professional. In order to analyse this, the Romanian Court is taken as a reference system.
