Summary/Abstract: The article The Regulation of the Contractual Relations on Public Health Assistance through the Social Insurance System is based on the provisions of Law 95/2006 on health reform and on the views expressed in the doctrine, also taking into account the EU legislation and the ECHR jurisprudence. The study reveals several aspects of the legal nature of the contractual relations in the healthcare field. The author discusses the existence of a branch of medical law and of the legal medical relationship. After presenting the pros and cons, the author concludes that the legal relationship in the system of health social insurance is a mixed nature relationship, to which public law rules and private law rules are applicable.
