Summary/Abstract: The general rule for public procurement is to use and to respect all the regulations from the Government Emergency Ordinance no. 34/2006 , that conclude the dispositions of the Public Procurement Directives, when works, services or good are brought from public money. Concerning the scope of the Government Emergency Ordinance no. 34/2006, I am studying three situations excepted from this rule, the direct acquisition, the private acquisitions from non-repayable grants and the acquisitions of services, included in Annex 2B of the Government Emergency Ordinance no. 34/2006. Through this article I’m presenting the three procedures and the practical problems coming into scene, when a bidder or a beneficiary uses the two excepted procedures. The acquisitions that have a value under the limits included in article 19 from the Government Emergency Ordinance no. 34/2006, doesn’t need organizing a procedure, needing just a justification. The acquisitions organized by a private person that will be funded from non-repayable grants, with a value between the limits included in article 19 and the limits from article 9 from the Government Emergency Ordinance no. 34/2006, and the acquisitions of services included in the annex 2B to the Government Emergency Ordinance no. 34/2006, that will be organized under special rules established for each authority itself.
