Summary/Abstract: A functional energy market in the absence of a regulator cannot exist; therefore the first condition is the establishment and the existence of this body. An independent functional and regulatory decision-making is the second condition. Both fail and is not sufficient in itself for the functionality of the energy market. The rules of law in force can give some possible solutions, such transparency which would lead to a regulatory body’s efficiency in energy.
