Summary/Abstract: The Japanese legal system, which is a part of the Far East legal culture, is characterized on the one hand by its susceptibility to reception and adaptation of foreign solutions, and on the other hand by its attachment to domestic legal traditions, closely related to cultural features and social axiology. This causes a certain tension between the letter of law and actually functioning legal norms, visible in the context of the relation between the sources of law and custom and jori, the special role of administrative recommendations (gyoseishido) or the position of mediation in relation to formalized legal procedures. Consequently, this tension, which means opening the law to social norms, can be treated as an element of a specific relation between the spheres of tatemae and honne.
