Summary/Abstract: A comparative analysis of the rules that protect possession offenses in the Penal Code in force wording criminal provisions contained in the Penal Code of 1969, there is an expansion in the number of situations in which conditional expected commissioning of formulating criminal action complaint by the victim or the possibility of applying the institution of reconciliation.Control of constitutionality regarding the two cases incidental to remove criminal liability, configures main problems generating discussion, namely that of extending them by configuring the same type of legal treatment, under the rule of the Penal Code of 1969, checking principles application of more favorable criminal law under the current penal Code empire.
