Summary/Abstract: In the current research we have proposed to make remarks regarding agency agreements as a vector for the investment in Small and Medium-Sized Enterprises in Romania. The agent is the person who based on a power of attorney from a trading operator concludes legal acts on one's own behalf and in the interest of the trading operator (art. 2009 Civil Code). Currently, there are over 400.000 small and medium-sized enterprises (SMEs) operating Romania. They contribute over 60 per cent of GDP and 70 per cent of state budget revenues, even though they hold less than 25 per cent of the national wealth. In the past, we have spoken of a great deal about the need to assist in the development of SMEs but at the same time enacted laws and promulgated ordinances that squeezed them financially to the point that thousands upon thousands of them went out of business.
