Procedural Aspects on Invoking the Prescription of the Right to Obtain Enforcement

Summary/Abstract: With the entry into force of the new Civil Code and the new Code of Civil Procedure it has been established the legal regime of the prescription of the right to obtain enforcement different from the previous one, in the sense that the prescription does not operate ope legis, but only at the request of the interested person. The article analyzes the persons who can invoke the prescription and the procedural means for its invocation.
