Summary/Abstract: The action in infringement constitutes an important element for protecting the industrial property rights, calling for the liability of the person infringing upon the right conferred to the proprietor of trademark. On civil matters, the liability is regulated by domestic law and as well, by european and international law. Of paramount importance for the plaintiff is the object of the claim which might be shaped in a large variety, depending on the legal content of the protected right and the specific remedy provided by the law. Our purpose is to analize the variety of claims brought before the specialised Courts in relation with the purpose of the plaintiff and the specific legal protection.
